Who we are
Horbit is a product of Monolith Technologies Limited, a company incorporated in Nigeria and registered with the Corporate Affairs Commission under registration number RN9200427. You can reach us at info@monolith.ng.
These terms form an agreement between you (and, if you sign up for an organisation, that organisation) and Monolith Technologies Limited (“Monolith”). They should be read together with our privacy policy, which explains how personal data is handled.
Accounts and workspaces
You must be at least 18 and have authority to act for the organisation you register. You are responsible for everything that happens under your account and workspace.
- Give accurate information when you register, and keep it up to date.
- Keep your sign-in details, passkeys and two-step devices secure. Tell us at once if you think someone else has access.
- A workspace has an owner. The owner is responsible for the people they invite and the roles they give, and for removing access when someone leaves.
- A workspace has its own address (a subdomain of Horbit or a custom domain you connect). Do not use an address that imitates another organisation.
Acceptable use
You must use Horbit lawfully and in good faith. You must not use it to:
- send unsolicited or bulk messages to people who have not agreed to receive them, or who have opted out;
- buy, rent or scrape contact lists, or load people into a campaign without a lawful basis;
- impersonate a person or organisation, or request a sender ID you are not entitled to use;
- send fraudulent, abusive, hateful, sexually explicit or threatening content, or content that infringes someone’s rights;
- distribute malware, probe or attack our systems or other workspaces, or try to get around usage limits, rate limits or access controls;
- use WhatsApp in a way that breaks WhatsApp’s own terms or that is designed to avoid a restriction on your number.
We may remove content, pause sending or suspend access where we reasonably believe these rules are being broken. Where we can, we will tell you why first.
Your members’ data and consent
Your organisation decides why it holds personal data about its members, attendees and contacts, and it is responsible for having a lawful basis for every use. That includes consent to receive marketing messages where the law requires it.
When you use Horbit to handle that data, you instruct us to process it on your behalf, for the purposes described in this document and in our privacy policy. We will process it only on those instructions, keep it secure, and help you respond to requests from the people concerned.
You must honour unsubscribes and opt-outs, and you must not use Horbit to get around them.
Messaging: email, SMS and WhatsApp
Messages are sent through providers we do not control, and each provider has its own rules and limits. We pace sending to protect your sender reputation and your WhatsApp number, but we cannot guarantee delivery or that a provider will never restrict a number or sender ID.
- Sender IDs must be approved by the gateway before they are used. Approval is not guaranteed.
- You link your own WhatsApp number and remain responsible for how it is used.
- We may pause a campaign whose bounce or complaint rates are high, to protect deliverability for everyone on the platform.
Units, wallets and fees
Some features are metered in units: for example campaign emails, SMS, WhatsApp messages, certificates and AI drafts. You buy units in advance and they are deducted when a metered action runs.
- Units do not expire.
- Before a send, we reserve the units it needs. When the send finishes, we settle the units it actually used, and any difference is returned to your wallet.
- Unit prices and the free allowance are shown on our pricing page at the time you buy. We will tell you before any change to the price of units.
- Units are not transferable and cannot be exchanged for cash, except where the law requires it.
Payments your members make
When your members pay you through Horbit, payments are processed by Paystack and settle to the payout account you give us. Horbit adds a small fee to the amount the payer pays, so that your organisation receives the full price you set. The fee schedule is shown before the payer pays.
You are responsible for the goods, services or memberships you sell, for issuing any refunds to your members, and for handling disputes and chargebacks with them. If a payment is reversed, we may reverse the matching settlement from your account.
Events, calls and recordings
You are responsible for your events, their terms, and any agreements your attendees sign through Horbit.
If you record a call, you must tell every participant before it starts, and you must have any consent the law requires. Recordings are deleted after the retention period described in our privacy policy, unless your plan sets a different period.
AI features
Some features draft text using third-party AI models. The output may be inaccurate, incomplete or unsuitable for your purpose. You must review anything drafted this way before you send it, publish it or rely on it.
Do not submit personal data to an AI feature unless you have the right to do so.
Your content
You keep ownership of the content you upload or create in Horbit, including member lists, text, images, certificates and recordings. You give us the licence we need to host, copy, process and display it in order to run the service for you.
Horbit, including its software, design, documentation and trademarks, belongs to Monolith Technologies Limited. These terms do not give you any right to it beyond using the service.
If you send us feedback or suggestions, we may use them without obligation to you.
Availability and support
We work to keep Horbit available and your data safe, and we tell you about planned maintenance in advance where we can. Unplanned outages are investigated and we will tell affected workspaces what happened once we know.
Horbit is provided as it is, without guarantees beyond those the law requires, unless a separate written agreement says otherwise.
Liability
Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud or for death or personal injury caused by negligence.
To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost opportunities or loss of goodwill. Our total liability to you for any claim arising from the service is limited to the fees and units you paid us in the twelve months before the claim.
Indemnity
You will indemnify Monolith Technologies Limited against claims that arise from your breach of these terms, from the messages you send, or from your handling of your members’ data, to the extent the claim is caused by your breach.
Ending your use
You can stop using Horbit at any time. Before you close a workspace, export the data you need, including event registrations, membership records and any certificates you have issued. Closing a workspace does not refund prepaid units except as described in Units, wallets and fees.
We may suspend or end a workspace that breaks these terms or the law. Where we can, we will tell you why first and give you a chance to put things right. After a workspace closes, data is handled as described in our privacy policy.
Changes to these terms
We may update these terms. For material changes we will tell workspace owners by email before the change takes effect, and we will update the date on this page. If you keep using Horbit after a change takes effect, you accept the updated terms.
Governing law and disputes
These terms are governed by the laws of the Federal Republic of Nigeria. We would prefer to resolve any dispute with you directly and in good faith. If we cannot, it will be decided by the courts of Nigeria.
